Environmental Advocacy: Insights From East Asia, Mary Alice Haddad Jul 2017

Environmental Advocacy: Insights From East Asia, Mary Alice Haddad

Mary Alice Haddad

Environmental advocacy in East Asia takes place in a context where there are few well-funded professional advocacy organisations, no viable green parties, and governments that are highly pro-business. In this advocacy-hostile environment, what strategies are environmental organizations using to promote better environmental outcomes?  Using an original database of environmental organizations and interviews with activists and officials throughout the region, this paper investigates which strategies are most common and compares them to the advocacy strategies found in the United States.  It finds, perhaps surprisingly, that (a) environmental organizations across East Asia employ similar advocacy strategies even though they are operating in ...

I Share, Therefore It's Mine, Donald J. Kochan Apr 2017

I Share, Therefore It's Mine, Donald J. Kochan

Donald J. Kochan

Uniquely interconnecting lessons from law, psychology, and economics, this article aims to provide a more enriched understanding of what it means to “share” property in the sharing economy. It explains that there is an “ownership prerequisite” to the sharing of property, drawing in part from the findings of research in the psychology of child development to show when and why children start to share. They do so only after developing what psychologists call “ownership understanding.” What the psychological research reveals, then, is that the property system is well suited to create recognizable and enforceable ownership norms that include the rights ...

The Middle Class, Urban Schools And Choice, Michael Lewyn Oct 2016

The Middle Class, Urban Schools And Choice, Michael Lewyn

Michael E Lewyn

Urban schools tend to be less attractive to middle-class parents than suburban schools; as a result, the public school system generates suburban sprawl.  This talk discusses both egalitarian and market-oriented means of making cities more attractive to parents.

Unequal exposure to urban air pollution in North American cities continues to challenge even leaders in sustainability like Seattle. In 1994, the city developed the first US comprehensive plan for sustainability but after two decades, progress on air quality remains uneven. Some neighborhood residents endure more than double the rates of childhood asthma hospitalizations in the city and disproportionate air pollution exposures. In the first part of our paper, we set the case of Seattle’s environmental justice politics within critical geography’s literature on scalar politics and the growing field of Community-Based Participatory Research. In the second part of ...

Incumbent Landscapes, Disruptive Uses: Perspectives On Marijuana-Related Land Use Control, Donald J. Kochan Dec 2015

Incumbent Landscapes, Disruptive Uses: Perspectives On Marijuana-Related Land Use Control, Donald J. Kochan

Donald J. Kochan

The story behind the move toward marijuana’s legality is a story of disruptive forces to the incumbent legal and physical landscape. It affects incumbent markets, incumbent places, the incumbent regulatory structure, and the legal system in general which must mediate the battles involving the push for relaxation of illegality and adaptation to accepting new marijuana-related land uses, against efforts toward entrenchment, resilience, and resistance to that disruption.

This Article is entirely agnostic on the issue of whether we should or should not decriminalize, legalize, or otherwise increase legal tolerance for marijuana or any other drugs. Nonetheless, we must grapple ...

Redistributing Power In Mississippi: The Reversal Of Section 4 Of The Voting Rights Act, Gloria J. Billingsley, Sylvester Murray Mar 2015

Redistributing Power In Mississippi: The Reversal Of Section 4 Of The Voting Rights Act, Gloria J. Billingsley, Sylvester Murray

Sylvester Murray

Recently, the U.S. Supreme Court declared Section 4 of the Voting Rights Act of 1965 unconstitutional, essentially defanging preclearance requirements of Section 5 and leaving racial and other previously disenfranchised minorities unprotected. Using social contract theory as the theoretical framework, empirical field study research was used to examine whether the Voting Rights Act has achieved the results in Mississippi that the Supreme Court’s decision to revoke Section 4 has assumed. Data were collected on race-specific voter registration and voting data, measures of vote discrimination, litigations and Mississippi legislative activity regarding voting rights. Findings indicate that the gap between ...

Increasing Environmental Performance In A Context Of Low Governmental Enforcement: Evidence From China, Mary Alice Haddad Jan 2015

Increasing Environmental Performance In A Context Of Low Governmental Enforcement: Evidence From China, Mary Alice Haddad

Mary Alice Haddad

How can activists and policy makers encourage better environmental behavior in a context of poor governmental enforcement? This article examines the case of the Institute of Public & Environmental Affairs, a Chinese nonprofit organization, to show how a transparency-based platform can encourage brand-sensitive multinational corporations, their suppliers, their investors, local governments, and consumers to behave in more environmentally responsible ways, even in a context of low governmental enforcement. Using Institute of Public & Environmental Affairs as its model, this article argues that a transparency-based platform can serve an important coordinating function across multiple sectors, creating a mechanism through which market forces are ...

The Right To Freedom Of Expression And Media Reporting On Criminal Proceedings In Tanzania: Finding The Balance, Joseph Wawa Raphael Futakamba S

Joseph Wawa Raphael Futakamba s

This paper examines the impact of media reporting to crime and criminal court proceeding in Tanzania in the light of exercising the legitimate right to freedom of expression by the press, on one hand and the accused rights to presumption of innocence and fair trial on the other hand. The purpose of the discussion revolves around the effect of prejudicial crime reporting to the criminal suspects/accused and available remedies within the legal system. Transnational Models Of Citizen Participation: The Case Of Participatory Budgeting, Yves Sintomer, Carsten Herzberg, Anja Roecke Dec 2012

Transnational Models Of Citizen Participation: The Case Of Participatory Budgeting, Yves Sintomer, Carsten Herzberg, Anja Roecke

yves sintomer

This article pursues two main objectives. First, it provides a transnational overview and analysis of participatory budgeting, which has been central to the literature on democratic innovations in citizen participation. Second, it combines this broad empirical project with a theoretical approach based on the construction of ideal-types in the Weberian tradition. Namely, it presents six models of citizen participation: participatory democracy, proximity democracy, participative modernization, multi-stakeholder participation, community development and neo-corporatism. Although these models have evolved from participatory budgeting and the European context, it is our contention that they can help us to understand the socio-political and ideological dynamics, contexts ...

Beyond The Plaza: Barcelona’S Okupa Squatters At Work In The Wake Of La Crisis, Justin Helepololei

Justin AK Helepololei

As ongoing, financial crisis has kept millions in precarity - and over 40% of Spain's youth unemployed - mass mobilizations of the country's indignados have continued to fill the country's streets and plazas. Nearly one year after the original 15M demonstrations, city-wide occupations have triggered a profusion of more localized and issue-based assemblies. Beyond the plazas, squatter-activists of Barcelona's decades-old “okupa movement” have helped to facilitate the continuation of these dialogues by offering space within dozens of pre-existing squats and even opening new sites to host such interactions. Leveraging decades of experience and skill in re-appropriating spaces, squatters ...

Nonpunctuated And Sweeping Policy Change: Bhutan Tobacco Policy Making From 1991 To 2009, Michael S. Givel Aug 2012

Nonpunctuated And Sweeping Policy Change: Bhutan Tobacco Policy Making From 1991 To 2009, Michael S. Givel

Michael S. Givel

This paper examines policy outputs associated with the 2004 Bhutan antitobacco law, including 2009 amendments, to determine if the law is congruent with punctuated equilibrium or social policy realism theories of policy change. There was no direct and sudden tobacco policy output change in Bhutan due to a shock to the policy system contrary to what punctuated equilibrium theory would predict. Rather, policy change was sweeping but nonpunctuated. This paper reconfirms prior findings of social policy realism theory that various and complex policy output patterns occur due to a mixture of contingent and complex factors. Under social policy realism, a ...
