State Displays Of Confederate Symbols: Legal Challenges And The Political Question Doctrine, J. Michael Martinez

Official state displays of Confederate symbols, especially in state flags, have been challenged in court in recent years. In challenging such displays, plaintiffs often have relied upon various constitutional and statutory provisions, including, in order of preference, the Fourteenth, Thirteenth, and First Amendments, as well as various civil rights statutes and the Voting Rights Act of 1965. In most instances, however, courts have held that cases involving state displays of Confederate symbols are political questions that should be addressed in a legislative, not judicial, forum. Comparative Democracy And Income Distribution: Shape And Direction Of The Causal Arrow, Ross Burkhart

Few research studies examine the effect of income distribution on democracy cross-nationally in a simultaneous equation environment (with democracy also influencing income distribution). The most recent such study asserts that no linear relationship exists between the two variables, without testing for nonlinear relationships. In this study, I operationalize democracy and income distribution for 56 countries over the years 1973–1988. I find through pooled two-stage least-squares estimation that democracy and income distribution have nonlinear effects on each other (inverted U-shaped curves). I reflect on these findings as they affect public policy.

Theory: We propose a theory of corporate taxation in the United States that builds on dynamic optimal taxation models. The theory is consistent with structural dependence theories (Lindblom 1977) in that expectations by investors of future tax policy limit policy maker options, primarily because corporate tax policy is time inconsistent. This theory contrasts with pluralistic models of corporate taxation because it recognizes the collective action problem facing business.

"The Rebirth Of Party: The 1994 Congressional Elections In Historical Perspective", Richard M. Skinner

Richard M. Skinner

The Republican surge of 1994 poses serious problems for most theories of congressional elections, which either discount the likelihood of such a swing, or attribute one to a readily apparent short-term cause. This essay includes a district-level analysis that finds a strong link between the 1988-92 presidential vote and the 1994 House vote. A discussion of theories of realignment leads to a conclusion that while the U.S. political system is changing, a new Republican era may not yet be upon us.
