Rising Assertiveness Versus Peaceful Development: Making Sense Of China’S Ambivalent International Behavior, Lukas K. Danner

Dr. Lukas K. Danner

In the past few years, especially after the 2008 global financial crisis, China has become more assertive, not just in its military posture but also in its diplomatic affairs and economic interactions. Despite this rising assertiveness, China’s grand strategy officially remains that of ‘Peaceful Development.’ In consequence, scholars have disagreed about the trajectory of China’s grand strategy in light of its often ambivalent behavior. To explain this ambivalence, this article will take a closer empirical look at  two important developments regarding China’s international affairs: The softening on China’s preoccupation with territorial integrity and sovereignty has been ...

Securitization And De-Securitization In The Diaoyu/Senkaku Islands Territorial Dispute, Lukas K. Danner

Dr. Lukas K. Danner

Recently, the territorial dispute over the Diaoyu, or Senkaku, Islands in the East China Sea has flamed up between China and Japan. This conflict deserves further attention because of its potential of being the spark to unleash a Sino-Japanese firefight. However, this was not the first time the two Northeast Asian great power rivals have at least verbally fought over who is the rightful owner to the resource-rich archipelago and surrounding waters. The controversy can be traced from post-World War II, over the 1970s and 1990s, to today. The entire process of this largely verbal fistfight can be best understood ...

Oil Exploitation As A Factor Of Violent Conflict Between Sudan And South Sudan, Anne Hamilton Dec 2012

Oil Exploitation As A Factor Of Violent Conflict Between Sudan And South Sudan, Anne Hamilton

Anne Hamilton

Sudan was in a state of civil war for most of the years following independence in 1956, apart from a temporary respite between 1972 and 1983. After hostilities resumed, the Sudan People's Liberation Movement/Army (SPLM/A) captured Leer from the government in March 1986, and the town became a stronghold of the rebel commander Riek Machar, who had been born there. In August 1991 Riek Machar broke away from John Garang's mainstream branch of the SPLM/A. Machar's breakaway faction was called the SPLM/A-Nasir faction from 1991 to 1993, and then the South Sudan Independence ...

Aspectos Democraticos De La Ley De Ordenamiento Territorial Y Usos Del Suelo De La Provincia De Mendoza Nª 8051, Luis Gabriel Escobar Blanco

In these times when direct forms of democracy burst before formal institutions, the Land Use Planning Law in the Province of Mendoza is presented as valid and democratic alternative, which integrates direct citizen participation with the constitutional representative principle, contemplating identity cultural as a valid indicator for the management modelThis Law Nº 8051 formalizes and concrete the spirit of the quintessential democratic in three principles: government of the people, by the people and for the people. And we add our tradition the principle "the people want to know what it is"

Between “Metaphysics Of The Stone Age” And The “Brave New World”: H.L.A. Hart On The Law’S Assumptions About Human Nature, Péter Cserne Dec 2011

Between “Metaphysics Of The Stone Age” And The “Brave New World”: H.L.A. Hart On The Law’S Assumptions About Human Nature, Péter Cserne

Péter Cserne

This paper analyses H.L.A. Hart’s views on the epistemic character of the law’s assumptions about human behaviour, as articulated in Causation in the Law and Punishment and Responsibility. Hart suggests that the assumptions behind legal doctrines typically combine common sense factual beliefs, moral intuitions, and philosophical theories of earlier ages with sound moral principles, and empirical knowledge. An important task of legal theory is to provide a ‘rational and critical foundation’ for these doctrines. This does not only imply conceptual clarification in light of an epistemic ideal of objectivity but also involves legal theorists in ‘enlightenment ...

Public Option, Kristin Dolbeare, Nora Heaton, Ellen Thomas, Peter E. Visser Apr 2010

Public Option, Kristin Dolbeare, Nora Heaton, Ellen Thomas, Peter E. Visser

Ellen Thomas

American health care woes are no new phenomena, and recent history demonstrates the intensity of the concomitant debate that arises following the proposal of a new system or a special new element-namely, the public insurance option. Early in his tenure, President Clinton dared to undertake daunting reform efforts (including the creation of a public insurance option). Many argue that losing the health care battle hampered Clinton's ability to effectively lead and will damage his long-term reputation. Barack Obama is now deep in the same trenches, and both Democrats and Republicans have begun asking questions: Is it too expensive?; Is ...
