In Reason, Tradition, and the Good, Jeffery L. Nicholas addresses the failure of reason in modernity to bring about a just society, a society in which people can attain fulfillment. Developing the critical theory of the Frankfurt School, Nicholas argues that we rely too heavily on a conception of rationality that is divorced from tradition and, therefore, incapable of judging ends. This paper contains the introduction to the new book, All Judges Are Political—Except When They Are Not: Acceptable Hypocrisies and the Rule of Law (Stanford University Press, 2010).

The book begins with the observation that Americans are divided in their beliefs about whether courts operate on the basis of unbiased legal principle or of political interest. This division in public opinion in turn breeds suspicion that judges do not actually mean what they say, that judicial professions of impartiality are just fig leaves used to hide the pursuit of partisan purposes.

Open Secret: Why The Supreme Court Has Nothing To Fear From The Internet, Keith Bybee

The United States Supreme Court has an uneasy relationship with openness: it complies with some calls for transparency, drags its feet in response to others, and sometimes simply refuses to go along. I argue that the Court’s position is understandable given that the internet age of fluid information and openness has often been heralded in terms that are antithetical to the Court’s operations. Abstract: In recent decades, the structure of the American family has been revolutionized to incorporate families of diverse and unconventional compositions. Gay and lesbian couples have undoubtedly played a crucial role in this revolution by establishing families through the tool of adoption. Eleven adoptive parents from the state of Connecticut were interviewed to better conceptualize the unique barriers gay couples encounter in the process adoption. Both the scholarly research and the interview data illustrate that although gay couples face enormous legal barriers, the majority of their hardship comes through social interactions. This article explores the question of the nature of the differences between analytic and continental styles of philosophizing, raising the political stakes of the professional differentiation between, and especially: the denial of the difference between analytic philosophy and continental philosophy. Discusses the question of the annexation of the philosophical themes of continental philosophy on the part of analytic philosophy, annexation because it is not dialogical or hermeneutical, appropriation or cooption simply by refusing the distinction between styles altogether.

Conflict can trap a country in poverty and economic stagnation. This chapter presents a case study of agriculture’s role in post-conflict Cambodia. Opportunities exist for improving rural livelihoods in Cambodia through the livestock sector. Even more promising is the rice sector, but only if rice milling (processing) can emerge and replace large unofficial exports of husked rice to neighbouring countries (primarily Vietnam). Value addition has not been Cambodia’s forte. Agriculture’s primacy is undeniable, given that it is the only sector capable of absorbing the 300,000 entrants joining the labour force each year. Hayek’s and Simon’s social externalism runs on a shared presupposition: mind is constrained in its computational capacity to detect, harvest, and assimilate “data” generated by the infinitely fine-grained and perpetually dynamic characteristic of experience in complex social environments. For Hayek, mind and sociality are co-evolved spontaneous orders, allowing little or no prospect of comprehensive explanation, trapped in a hermeneutically sealed, i.e. inescapably context bound, eco-system.
