Abortion is legal in China. It is a government service available on request for women, yet it has recently generated ethical concerns. This paper investigates and analyzes the rationales given by women who have gone through induced abortion voluntarily or involuntarily, and reflects on the ethical and legal problems in China today. Daoism, one of China’s major philosophical and religious traditions, emphasizes such notions as holism, organicism, and naturalness, promoting the idea of living in line with the rules and patterns of nature. This essay examines the Daoist ethics of living naturally with special attention given to abortion. It points out that for philosophical Daoism, abortion is not acceptable because it is considered an “artificial” action for a self-serving purpose, such as aborting an unwanted baby girl after a sex test on a fetus. Abortion is a perennial problem in the West. This essay shows that although the three major Western approaches to this issue – pro-life conservativism, pro-choice liberalism and the third way view that supports early but disallows late abortions – sound quite incompatible with each other, they nevertheless share a fundamental idea. They take the maternal-fetal relation as a relation between two unrelated right-holders, the pregnant woman and the fetus. This essay examines the shortcomings and limitations of the rights-based approach to the problem of abortion, and explores Confucianism as an alternative in providing a theoretical framework for handling that problem. It mainly focuses on the downside of the rights-based approach and the upside of the Confucian approach.

Warren and Brandeis 有關侵犯隱私權之訴訟,有一個主要是社會性目標:獲得法院的同情,強化文明的規範。多年以後,在Griswold v. Connecticut(1965)的案例裏,最高法院宣示以個人為焦點的一項隱私的憲法權利。在這個及往後有關墮胎及「死之權利」的判例裏,即顯然看出,Warren and Brandeis 那種維多利亞式的「不受打擾的權利」(the right to be let alone)已變形為自主的權利,其多種變形使得加以預測甚至是描述,都成為棘手的事。然而,隱私乃是自主的一項不充分的代理(an unsatisfactory proxy for autonomy),也許正因為如此,其作為這些領域中的根據之重要性,已然縮減。
