On May 20, 2010, the Craig Venter Institute, a U.S. private research institution, announced that they had successfully synthesized bacterial deoxyribonucleic acid (DNA) and implanted it in another bacterium. After several attempts, the implanted artificial DNA regained life and began to reproduce in a lab dish. This “artificial life” was named “Synthia” (meaning “man-made children”). Traditional Chinese medical theory holds that medicine and food come from the same source. As means of both preventive remedies and treating disease, medicine and food are categorized according to their “effectiveness,” which in turn connects things with their specific phases in the natural world. The Shanhaijing (the Classic of Mountains and Seas) is largely a fabled geographical and cultural account of pre-Qin China as well as a collection of myths. ln this paper I examine the arguments for and against the buying and selling of human organs . I examine five opposing and two supporting arguments. The five opposing arguments are: (I) exploitation of the poor; (2) fostering crime; (3) creating a conflict between a person and his family; (4) contributing to the prevailing ethos of everything being for sale; (5) degrading human dignity. The two supporting arguments are: (1) self-ownership of human beings; (2) effective use of resources.

一系列病例使有關醫學治療何時有效、何時無效的爭端明確化、具體化,因而也使有關醫患關係、資源分配、醫患間的溝通交流、同情心、病痛的緩解、自主權、治療不足和治療過度、家長式的獨斷作風及姑息治療的爭端明確化、具體化。暸解有效和無效是相輔相成的概念,對我們的醫療實踐有益。對治療在爭議性病例是有效還是無效的判斷,有著共同的特點:(1)以醫學科學為依據;(2)反映多種價值;(3)處於或接近有效閾;(4)令人負擔沈重。我們應關注構成這些判斷基礎的經驗要素、倫理要素及評估要素的正當理由,而不是做出有關是醫生、病人,還是社會一致認同應成為最終決定因素的專橫決定。

對使用人類基因轉移技術治療健康問題與使用該技術增強或改善正常人遺傳特性加以區分已成為討論基因治療倫理學的標準。一些人對這一區分的規範力提出質疑,認為這忽視了如何在醫學上合法使用人類基因轉移技術預防疾病。例如,用基因工程增強免疫功能,改進DNA修復功能或增添細胞受體獲得和處理膽固醇的功能。一些批評者認為。如果疾病預防是醫學的正當目標,使用基因轉移技術增強人類健康維護能力將有助於實現這一目標。然而,“治療/增強”的區分法不能對合法的基因治療進行界定。我論證在基因治療的預防與增強(以及在基因治療醫學方面的正確使用與基因治療非醫學方面的使用)之間能夠劃一條線,但只有你願意接受以下兩種老式的主張:1)一些健康問題最好被理解為體現在生物系統中的各種過程或部分的實體,至少具備了像受抑制的功能一樣的本體論客觀性與理論意義。2)合法的預防性基因保健應該限於努力保護人的不受更強有力的病理實體的侵襲,而不是改變他們的身體以逃避社會的不公正。
