What's So Private About Private Property?, Matthew Blake Wilson

This work attempts to determine what kinds of institutions—if any—the state should implement to protect private property, and investigates how individuals and communities operating within those institutions ought to behave. Because the laws produced by such institutions may conflict with community rights, social welfare, and justice, the political authorities—including judges and legislators—who operate the institutions must determine whether, and under what conditions, individual property rights ought to prevail over conflicting rights.
