Privacy Torts: Unreliable Remedies For Lgbt Plaintiffs, Anita L. Allen Oct 2010

Privacy Torts: Unreliable Remedies For Lgbt Plaintiffs, Anita L. Allen

Faculty Scholarship at Penn Law

In the United States, both constitutional law and tort law recognize the right to privacy, understood as legal entitlement to an intimate life of one’s own free from undue interference by others and the state. Lesbian, gay, bisexual, and transgender (“LGBT”) persons have defended their interests in dignity, equality, autonomy, and intimate relationships in the courts by appealing to that right. In the constitutional arena, LGBT Americans have claimed the protection of state and federal privacy rights with a modicum of well-known success. Holding that homosexuals have the same right to sexual privacy as heterosexuals, Lawrence v. Texas symbolizes ...

A New Bloomsbury? Forster, Cadmus And The Frenches In Greenwich Village, Wendy Moffat Oct 2010

A New Bloomsbury? Forster, Cadmus And The Frenches In Greenwich Village, Wendy Moffat

Faculty and Staff Publications By Year

E. M. Forster surprised two young painters at work in their Greenwich Village studio one April morning in 1947, bounding up four flights of the dilapidated brownstone like a man much younger than his sixty-eight years. The landing opened into a railroad apartment whose outer rooms were fashioned into workspace. Paul Cadmus's orderly studio faced north, with a view of scraggly trees and the brick face of a tenement. Jared French's room had "a medieval alchemist's look of disorder: large anatomy books, an Houdon écorché with muscles painted on, bottles of powdered pigments, dirty work clothes" piled ...

Time Will Tell: Community Acceptability Of Hiv Vaccine Research Before And After The "Step Study" Vaccine Discontinuation, Paula M. Frew, Mark J. Mulligan, Su-I Hou, Kayshin Chan, Carlos Del Rio

Environmental & Occupational Health Faculty Publications

Objective This study examines whether men-who-have-sex-with-men (MSM) and transgender (TG) persons’ attitudes, beliefs, and risk perceptions toward human immunodeficiency virus (HIV) vaccine research have been altered as a result of the negative findings from a phase 2B HIV vaccine study. Design We conducted a cross-sectional survey among MSM and TG persons (N = 176) recruited from community settings in Atlanta from 2007 to 2008. The first group was recruited during an active phase 2B HIV vaccine trial in which a candidate vaccine was being evaluated (the “Step Study”), and the second group was recruited after product futility was widely reported in ...

Gender (In)Query: Young Adults Learning, Unlearning, And Relearning Gender In A Queer Majority Space, Erin G. Cross Aug 2010

Gender (In)Query: Young Adults Learning, Unlearning, And Relearning Gender In A Queer Majority Space, Erin G. Cross

Publicly Accessible Penn Dissertations

As today’s discursive frames available to queer young adults reflect a stressful, shifting historical context for sexuality from ‘struggle and survive’ to emancipation, they still are confined by U.S. sexual norms assuming the authority of ‘truth’ while demanding heterosexuality. Consequently, sexuality and gender are linked inextricably as heterosexuality relies on the gender binary and the gender binary relies on heterosexuality. Via gender, queer, and situated learning theories this qualitative study decouples such mutual reinforcement to explore how queer young adults – who are already positioned outside of obligatory heterosexuality – learn, unlearn, or relearn gender in queer majority spaces. Research ...

Evaluating The Effects Of A Safe Space Training On Professional School Counselors And School Counseling Trainees, Rebekah Byrd Jul 2010

Evaluating The Effects Of A Safe Space Training On Professional School Counselors And School Counseling Trainees, Rebekah Byrd

Counseling & Human Services Theses & Dissertations

While professional and social advocacy is an important component of school counselor training, there is little information about the awareness, skills, or knowledge needed to effectively meet the academic, career, and social needs of LGBTQ students (Smith & Chen-Hayes, 2004). The purpose of this study was to evaluate and examine the impact of Safe Space training on Professional School Counselors (PSCs) and School Counseling Trainees (SCTs). In this experimental design, a sample of 74 PSCs and SCTs from three universities and one school district participated in 1 of 7 Safe Space trainings. The Safe Space training, developed by The Gay, Lesbian and Straight Educators Network (GLSEN), is a three hour program designed to educate participants about LGBTQ related issues and to provide strategies for support and intervention (2006). Program effectiveness was measured using the Sexual Orientation Counselor Competency Scale (SOCCS) (Bidell, 2005).

Results indicated that an overall significant change in participants' awareness, knowledge, and skills for working with LGBTQ individuals (i.e., LGBTQ competency) occurred. When LGBTQ competency components were examined separately, only the participants skills were significantly increased. Correlations examining the relationship between the awareness of sexism and heterosexism (POI subscales; Hays, Chang, & Decker, 2007) and knowledge, attitudes and skills were all found to be significant. Demographic variables were also examined in this study (e.g. number of perceived LGBTQ clients seen and gender) and were not supported. Implications of these results are discussed.
